Is the mother at fault here or is the police officer responsible for the death of a child in a gruesome car accident?

This Mother, Brittany Stephens, 20, was accused of negligent Homicide when her infant child died in a car crash. The Crash was initially created by an off duty police officer who was speeding at 94 mph. Officer Christoper Manuel was also charged with Negligent Homicide.

But why was the Mother who was not driving the car at the time, charged as well. The mother was charged because she was the one who strapped the baby in the car seat. Officer's say that the, "lack of securing the seat to the vehicle and the loose straps are contributing factor in the death of the child." and "shows gross negligence on the mothers behalf."
